Commercial Business Manager

KBR is looking for a dynamic and results-driven Commercial Business Manager (or Commercial Manager). In this role, you will be responsible for commercial leadership as part of a commercial team on a large project, in coordination with the rest of the project management team.  You will be expected to apply various problem-solving techniques and communication skills to engage client, supply chain, project team and/or functional support personnel to thoroughly understand and document issues and mitigations, and successfully negotiate resolutions aligned with company management decisions.  Assignments may be made to support pre-award and post-award project phases. Other opportunities may include development and implementation of company-wide training, and regular engagements with business leadership at various levels of the company. 

Functional job responsibilities will include but are not limited to:

  • Assigned to the KBR team supporting the project team primarily with the plan to transition as the role evolves.   

  • Actively supports the implementation of the Commercial Management function strategy and values during pre-award, post-award project execution and project close-out phases, on pursuits and/or projects. Works cross-functionally ensuring contract compliance and overall commercial integrity for the benefit of the pursuit/project.  

  • Works cross-functionally to support identification and analysis of project execution and contractual risks and opportunities and the related mitigations and actions, development, and implementation of contingency/exploitation plans, contract compliance, overall commercial integrity, and cost and schedule certainty for the benefit of the pursuit/project. 

  • Leads and guides project teams in understanding the project prime and supply chain contract requirements and obligations of all parties to maintain contract compliance and avoid contractual disputes; as a Business Manager, role may be responsible for leading other functions (procurement, subcontract support, etc, project support)

  • Work within the project team to develop the contracting strategy for the prime contract, major subcontracts and major purchase orders, claims, variations delays, and plan/lead this activity where appropriate. 

  • Day to day management of all non-technical project activities such that the Project Manager is consistently provided with accurate, timely and relevant information. 

  • Ensure Contractor complies to executed agreement and all non-compliances are detected early, communicated to Contractor and remedies identified to protect customers' technical, commercial and reputational interests. 

  • Develop and implement change management processes and procedures to promote proactive identification of commercial exposures and potential changes. Support change negotiation such that Customer is adequately protected from both time and cost increases by LSTK EPC Contractor. 

  • Develop and implement the project Claims Management Plan and promote project management team individual roles and responsibilities awareness. 

  • Review key subcontracts and purchase orders, including appropriate flow downs and other risk (insurance, indemnity, etc.) and compensation provisions from the prime contract. 

  • Draft required notifications, letters of entitlement and additional contract documents.  Be responsible for providing draft responses to Project Manager for all formal communication from EPC contracts. 

  • Protect the customer from claims; manage the coordination of subcontracts and procurement, legal and third party specialists to identify, evaluate and negotiate claims. 

  • Conduct periodic reviews to ensure project is working within established contractual commercial terms and financial targets. 

  • Develops, or assists with the development of, contracts training and orientation for project personnel and other members of the Contracts Management function. 

Required Education, Experience, & Skills:

  • An undergraduate degree, preferably in Business, Engineering, Law, Quantity Surveying (or similar).   

  • Minimum 12+ years relevant experience delivering solutions for contractors, subcontractors and owners on Energy, Consultancy, Technology and/or Government Services projects, and/or owners on Hydrocarbon, Government Services, Power, Mining or Infrastructure projects.  Significant experience with contract and subcontract formulation and administration, 

  • Experience in managing large PMC and in establishing complicated contracting strategy involving multiple EPC contractors

  • Prior hands-on experience in at least one of the following areas: risk management, contract administration, subcontracts, and/or project management. 

  • Experience of the entire project lifecycle in a EPC, or PMC contract management is essential in acquiring the knowledge necessary for effective commercial management and claims resolution. Field/project assignments for EPC, PMC, Services and/or Government Services projects is required. 

  • Strong written and verbal English communication skills 

  • Team player with the ability to work unsupervised and prioritize and execute commercial risk management activities to achieve deadlines. Proven experience of managing teams of contracts, legal and procurement staff.  

Preferred Education, Experience, & Skills: 

  • Experience of the entire project lifecycle is beneficial to possessing the knowledge necessary for effective risk identification and management. Field/project assignments for EPC, PMC, Services and/or Government Services projects 

  • Qualitative and analytical skills including data science and analysis 

  • Strong contracts understand for independent review to identify risks to KBR and assess mitigations 

  • Fluency in non-English languages
