Who we’re looking for
Toyota Financial Services’ Legal Department is looking for a passionate and highly motivated Managing Counsel – Servicing.
The primary responsibility of this role is to provide advice on a broad array of consumer finance issues, including auto finance servicing and compliance with applicable state and federal laws and regulations.
Reporting to the Assistant General Counsel, the person in this role will support the Legal department's objective to provide sound legal advice various business units.
This position is based in Plano, Texas. The selected candidate will be expected to reside within commutable distance of this location.
What you’ll be doing
Partnering with the servicing operations to evaluate, develop and implement consistent and strategically-sound policies, practices, and procedures
Monitor and advise the servicing operations on developments and changes in state and federal laws and regulations
Partnering with Compliance, Risk Management and Audit in a variety of areas, including state and federal regulatory examinations and inquiries, complaint analysis and root cause determinations
Evaluating, researching, and advising on pilots and strategic initiatives in the mobility finance space
Drafting consumer servicing notices, consumer servicing letters, and other legal documents
Managing the review and implementation of servicing processes and consumer communications in response to business needs and regulatory changes
Drafting and updating the company’s online policies and agreements and electronic communication consents
Reviewing and analyzing business practices and proposals for compliance with federal and 50 state laws and regulations governing the servicing and collection of consumer loans and leases secured by personal property
What you bring
Juris Doctor from an accredited law school
Currently licensed to practice law in any of the 50 states or the District of Columbia and able to be licensed to practice law in the state of Texas within one year of hire
Experience: 5+ years of relevant legal experience in a similar field or industry
Added bonus if you have
Experience with: State and Federal debt collection laws, Servicemember Civil Relief Act (SCRA), Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), UCC Article 9, Bankruptcy, laws and rules governing payments (Reg. E. Nacha Rules, Visa/Mastercard Rules), and Reg AB
Experience in servicing and collection of consumer credit accounts
Experience in working with Risk Management, Compliance, and Audit Additional Certifications: ex. CPA or PMP
2+ years of experience working in-house or as external counsel advising lenders in the auto finance industry
