Overview
The Assistant General Counsel, Employment Law has significant responsibility for managing employment law claims nationwide (which may include class/collective actions, single or multi-plaintiff actions in court, arbitrations, and government charges) as well as providing legal advice to the Company’s Operations and HR leaders in connection with a broad range of employment law matters including wage and hour, recruiting and hiring, restrictive covenant issues, performance management, compensation, separations, internal investigations, leaves of absence, policies and practices, reasonable accommodations, employee classification, safety issues, and other related topics. Client focus, strategic mindset, accountability, and agility are essential for navigating complex legal challenges fostering continuous process improvement. This role will play an important role in developing long term initiatives that align with ABM’s business strategy and will effectively collaborate with all levels of Operations and Human Resources.
This role is based in ABM's office in Sugar Land, TX and the successful candidate is expected to work in person a minimum of 4 days per week.
Essential Functions:
- Provide strategic management and oversight for ABM’s employment law claims nationwide including budgeting and managing legal costs and early resolution of these matters
- Provide clear, concise, and practical business-oriented legal advice – both written and verbal - to ABM’s operations and human resources teams on a daily basis regarding various employment law related topics
- Manage the preparation of responses to administrative charges and/or complaints filed with the EEOC, DOL, and related state and local agencies
- Monitor new legislation in assigned geographic region and make recommendations to the ABM operations and human resources teams on the best ways to operationalize the changes
- Conduct employment law related due diligence in connection with mergers, acquisitions, and other business transactions
Education & Experience:
- Minimum 8 years of relevant legal experience handling and/or managing employment law matters as an attorney which can be either in-house, in a law firm, or in the government
- Active, front-line litigation experience which includes court appearances, legal research, persuasive writing, and developing/implementing litigation strategy
- Excellent communication and collaboration skills including the ability to develop and deliver executive summaries, virtual and in-person presentations, and to cultivate positive relationships both internally and externally
- Extensive experience conducting independent legal analysis of laws and legal risks, and the ability to make reasoned and comprehensive decisions/recommendations while considering the operational realities, priorities, and the needs of the business
- Extensive experience proactively identifying and assessing legal risks and opportunities related to employment law compliance and providing practical business-oriented recommendations to internal clients on options to mitigate the risk
- Strong problem-solving skills with the ability to work independently or in a team to develop practical solutions to accomplish business objectives in a complex industry
- Strong organizational skills with a demonstrated ability to handle, prioritize, and follow through on a considerable volume of work
- Prior law firm experience highly desirable
- Prior experience providing legal advice on California employment law issues preferred
- Prior experience handling employment law issues in a union environment and/or labor relations experience is a plus
- Prior experience under the federal or state Occupational Safety & Health Act is a plus
- JD degree from an ABA accredited law school and admitted to practice law by the State Bar of Texas
- Proficient in MS Office 365 including MS Teams and Sharepoint
