SUMMARY OF DUTIES:
The Sr Mgr, Commercial Strategy & Development will provide support for contract and bid document development, incentive/disincentive strategy, market research, and market outreach for the Capital Delivery (CAPD) Project Development and Project Services (PDPS) department. This position will engage on commercial strategy and commercial terms for capital projects in the planning and procurement process. This position will provide support to capital project teams on commercial matters in the project execution phase as needed. This position will also engage on commercial strategy relative to contract claims analysis and resolution.
ESSENTIAL FUNCTIONS:
· Supports the Director, Commercial Strategy & Development, in the analysis of alternative delivery and contracting methods for use in transportation infrastructure projects.
· Researches and compiles latest industry best practices for alternative delivery methods and latest regulations/requirements.
· Provides support for contract development, contract negotiations (as needed) and assists with the preparation of recommendations for decision making purposes.
· Reviews new contract language for alternative delivery procurements and reviews the latest regulatory regulations/requirements. Supports selection plan development with Procurement and Project Delivery teams.
· Collaborates with Procurement team regarding commercial terms and agreements. Supports the procurements of all contractor and engineering services necessary to deliver large transportation infrastructure projects.
· Assists with updating standard offering documents and includes business requirements that are aligned with Amtrak needs in such documents.
· Works with Engineering Services, Project Development and Project Services, Project Delivery, Procurement and Supply Chain, and Legal offices to ensure compliance with Amtrak procurement policies. Reviews procurement documents for alignment with Business Case, Project Charter, and Project Management Plan recommendations.
· Supports pre-award activities to ensure source selection plan, evaluation criteria, solicitation amendments, pre-proposal conferences, and question clarification responses are appropriate, timely, and provide value to Amtrak.
· Supports market analysis/outreach to engage industry.
· Supports contract compliance and takes lessons learned from active contracts and proposes new commercial term development.
· Monitors status of certain alternative delivery procurement initiations and follows up with Procurement team and related offices to meet Project milestones.
· Performs a wide range of project, program, and policy development functions including conducting research, data analysis and framing recommendations for future contractual actions.
· Collaborates and builds relationships with internal Amtrak stakeholder departments to assist with managing all acquisition planning and contract compliance activities and ensuring all stakeholder groups are engaged to maximize value in our commercial terms.
· Executes research projects to address CAPD planning, procurement, and delivery needs. Supports market analysis and the execution, analysis, and report out on research findings on market trends, contractors, consultants, suppliers, and vendors to help maximize competition.
· Coordinates market outreach and develops strong working relationships and engagement with current and new contractors, consultants, suppliers, and vendors to increase competition on Amtrak procurements.
· Supports the development of in-house customer surveys; analyzes survey data; crafts discussion guides for qualitative studies, and manages ongoing internal surveys. Creates and maintains a repository of internal feedback to better support our internal stakeholders and maximize opportunities for improvement based on survey results. · Monitors developments and trends in the transportation industry to increase competition and reduce commercial risk for Amtrak on future procurements.
MINIMUM QUALIFICATIONS:
·Bachelor’s degree in Law, Construction Management, Contract Management, Business, or related field.
· A minimum of seven (7) years of business strategy, commercial term development, or contract management/development experience.
· In lieu of education a minimum of 10 years of relevant work experience, or equivalent combination of education, training, and work experience is needed.
· Prior management experience and demonstrated ability to lead teams and develop talent.
· Understanding of construction, engineering/architecture, delivery methods, and consultant contractual instruments including contract type and terms & conditions.
· Strong writing skills, including grammar, spelling, proofreading, organization, clarity, and conciseness.
· Superior quantitative and analytical skills. Experience in PC based applications, including Word, Excel, PowerPoint, financial planning/reporting systems, and other technology-based systems.
· Strong verbal and written communication skills, including ability to articulate complex issues and interact with all levels of Amtrak employees.
· Embraces learning new tasks, both complex and simple, to maintain effectiveness in this position.
· Demonstrated experience and ability to produce results within a team environment, to develop productive working relationships with external and internal stakeholders and to appropriately challenge or influence decisions.
· Demonstrated experience with contract and commercial language development.
· Demonstrated experience with alternative delivery construction contracts (e.g. Design-Build, Construction Manager at Risk, Progressive Design-Build, Public Private Partnership, Alliance).
· Mastery of critical thinking/problem solving, written and verbal communication, business acumen, and decision-making abilities
PREFERRED QUALIFICATIONS:
· Master’s degree in law, Engineering, Construction Management, Contract Management, Business, or related field.
· Professional licensure and/or certifications.
· Experience in negotiating complex issues and drafting appropriate contract terms.
· Excellent writing skills, including grammar, spelling, proofreading, organization, clarity, and conciseness.
· Demonstrated experience with business development and/or market research/analysis.
· Demonstrated experience with contract language development on public and private procurements.
· Demonstrated experience in developing contract incentive language for complex alternative delivery projects.
WORK ENVRIORNMENT:
· Office environment, however, candidate will need to attend field visits and travel as needed.
· Frequent problem resolution with conflicting priorities in cognitively demanding situations.
· Fast-paced environment with frequently changing priorities.
COMMUNICATIONS AND INTERPERSONAL SKILLS:
Must have excellent oral and written communication skills.
The salary/hourly range is $135,800-$176,040, Pay is based on several factors including but not limited to education, work experience, certifications, internal equity, etc. Depending on an employee’s assigned worksite or location, Amtrak may consider a geo-pay differential to be applied to the employee’s base salary. Amtrak may offer additional incentive and pay programs to recognize and reward our employees, including a short-term incentive bonus based upon factors such as individual and company performance that is commensurate with the level of the position and/or long-term incentive plan compensation.
